Making Sense of the CBD Market and the UK Regulations

Is CBD regulated in the UK?

For far too long, the CBD market was very poorly regulated and so low quality and unsafe products have been placed on the market and consumers have struggled to know that what they are buying is trustworthy and safe to consume.  Last year, the UK set out regulations and compliances, which companies need to now adhere to in order to produce and distribute CBD. Companies in the UK must submit a Novel Foods dossier to the European Food Standards Agency (EFSA) by March 2021 and, more importantly, be approved. If they do not do this, they will be removed from the market.

But, what does that mean?

To break it down, a “Novel Food” is a food that has not been consumed to a significant degree before 15 May 1997. The dossier application needs to cover a few requirements and provide proof that the product; (a) poses no risk to public health, (b) is not nutritionally inferior when replacing a similar food, and (c) is not misleading the consumer.

This means that products which are already on the market will need to provide the application showing the safety and stability of their CBD and make sure that their product is not being used for anything other than what is covered in their application. In the dossier, companies will need to detail their extraction techniques to provide transparency on the safety and traceability of their consumer chain. Once doing so, the FSA and EFSA will then review the dossier for scientific data backing. This is not an easy process, but it allows for every customer to understand what their product contains, the safety of a product they are choosing to ingest and it prevents gross misinformation.

These rules will limit companies from attempting to side-step legalities or strong-arming regulators, with the understanding that those actions could have serious consequences. This will further allow the UK to crack down on what has been viewed as an under-regulated CBD category, with the end goal of removing unauthorised products from shelves.

This information will be a fatal blow to many companies, however, this long-awaited regulation is a very positive change for the safety of consumers.
